  • New US Immigration Rule to Provide Unlawful Presence Waivers

    Undocumented family members of the US citizen suffer greatly due to the US immigration enforcement and deportation. If mainly affects the families that have on or more undocumented immigrant family members. In certain cases when the undocumented immigrant parents are deported, the children face a lot of difficulty as the family will be separated. According to a report, around 47,000 immigrants who have one US citizen children have been deported. The outcome of the deportation of a parent is always annihilating for kids and their parents.

    The new US immigration rule will help such undocumented immigrant family members. The USCIS has proposed a process which is likely to assist applicants for legal residency. According to the current law, immediate relatives of the US citizen who had overstayed for a certain period and those who were present in the US illegally are barred from returning to the US for 3 or 10 years depending on the period of their overstay. The immediate relatives can now obtain a waiver if they prove that their deportation and separation from the US citizen will cause extreme hardship. The applicants will still be required to depart the US and stay abroad until their waiver is processed. This may result in long separation. This process is difficult for young and the old people.

    Under the new process which has been proposed, the applicants who require a waiver of unlawful presence must file a form in order to get an immigrant visa. That can be done before they leave the US to acquire an immigrant visa at the US Embassy or the US consulate abroad. The applicants who are eligible for this process must depart the US an are required to meet all legal requirements to obtain an immigrant visa to enter the US.

    This new process is proposed to help the family members whose applications are eligible to be considered rapidly. According to the new proposal, steps involved in the process are not waived whereas the elements are just moved forward. There are around 11 million undocumented immigrants in the US and it is expected that one million among them must be able to find a rapid path towards legal residency. This new US immigration rule is likely to help undocumented immigrants to gain a bright future.
